And the debate is on
Have you been following the news these 2 days? Sat: Suhakam proposed that there should be laws regarding rape involving husband-wife. Sun: Mufti & cendekiawan Islam membantah sebarang usaha untuk menghukum a husband who rapes his wife, under the Penal Code. Suhakam 'dibelasah'.
Rape, under the Penal Code ialah apabila intercourse is without the women's consent. We've had this discussion in our classes for few times, and I am outraged by the fact that there is no such law.
My personal humble opinion: Betul, in Islam, isteri wajib taat etc etc. Tapi Islam itu agama yang sempurna, penuh rasional, dan amat menghormati hak wanita. Sungguhpun perkahwinan could be said as being sebuah bukti 'kerelaan' (consent) seorang isteri, suami tak punya hak mutlak. Maka, apabila seorang suami bertindak di luar batasan normal, pushy sehingga mencederakan mungkin, tidak menghormati kehendak dan keperluan isteri, bukankah itu melanggar norma dan rasional agama suci kita?
Para mufti contended that such suggestion by Suhakam is too liberated, a product of westernization. It is not. Hak asasi wanita telah wujud sejak zaman Nabi Muhammad lagi. When a woman is treated badly, dan tidak dihormati, the man in contempt should be punished.
Then again, this is not a learned opinion. It is not even done with proper research. I anyway demand a thourough debate and penyelidikan oleh govt on this matter. Hmm I always love Criminal Law, oh maybe I should do a research myself, sape nak sponsor?! What's your say?
